GENERAL TERMS AND CONDITIONS OF SALE

These General Terms and Conditions of Sale (hereinafter the “Terms and Conditions” or “T&Cs”) govern the sale of products made via the website atelier-capes-epees.fr (hereinafter the “Site”) between:

Any physical person of legal age acting as a consumer (hereinafter the “Customer”).

Any order placed on the Site implies full and complete acceptance of these Terms and Conditions, as well as the Return Policy, the Privacy Policy and the Shipping Policy available on the Site.


1. PRODUCTS

The products offered for sale are described and presented as accurately as possible (photos, descriptions, essential characteristics, materials, indications of use).
However, differences in colour or appearance may exist depending on screens or manufacturing batches. Such minor differences cannot be considered as a lack of conformity.

Certain items are intended for historical re-enactment, performance or decoration and do not constitute certified personal protective equipment. It is the Customer’s responsibility to check that the products are suitable for the intended use (training, performance, display, etc.).

L’Atelier des Capes & Épées reserves the right to modify or remove any product from the catalogue at any time.


2. PRICES

Prices are indicated in euros, all taxes included (VAT inclusive), excluding shipping fees.
Applicable shipping fees are indicated during the ordering process, before final confirmation.

L’Atelier des Capes & Épées reserves the right to change its prices at any time. Products are invoiced on the basis of the price in force at the time the Customer confirms the order.

In the event of a clearly incorrect displayed price (derisory or inconsistent price), L’Atelier des Capes & Épées may cancel the order, even after confirmation, and offer the Customer either to confirm the order at the corrected price or to receive a refund.


3. ORDER

The Customer places an order by selecting the products of their choice and following the steps indicated on the Site up to final validation.

Before confirming the order, the Customer can check the order details, the total price, the shipping fees, correct any errors and review these Terms and Conditions.

The order is only definitively registered after:

  • validation of the basket,

  • acceptance of the Terms and Conditions,

  • validation of payment.

The Customer then receives an order confirmation email, which serves as an acknowledgement of receipt. L’Atelier des Capes & Épées reserves the right to refuse or cancel any order in the event of an existing dispute with the Customer, total or partial non-payment of a previous order, suspicion of fraud or any other legitimate reason.

The information provided by the Customer when placing the order (address, telephone number, etc.) is binding on the Customer. In the event of an error, L’Atelier des Capes & Épées cannot be held responsible for any delay or impossibility of delivery.


4. PAYMENT

Payment for orders is made online using the methods offered on the Site (bank card, PayPal and/or other available payment methods).

Payment is due immediately upon ordering. The charge is made at the time the order is validated. By providing their banking details, the Customer authorises L’Atelier des Capes & Épées (or its payment service provider) to debit the total amount of the order.

Payment transactions are secured by partner payment providers. L’Atelier des Capes & Épées does not have access to the Customer’s full banking data.

If the bank refuses payment, the order is automatically cancelled.


5. DELIVERY

Products are delivered to the address indicated by the Customer when placing the order.
Detailed terms (delivery areas, shipping methods, estimated times, fees) are specified in the Site’s Shipping Policy and recalled at the time of ordering.

The indicated delivery times are average observed times and do not constitute a performance guarantee. L’Atelier des Capes & Épées cannot be held liable for delays attributable to carriers, customs procedures or any event beyond its control.

The risk of loss or damage to the products is transferred to the Customer when the Customer (or a third party designated by the Customer, other than the carrier) physically takes possession of the products.

In the event of a damaged parcel on delivery, it is the Customer’s responsibility to make clear reservations with the carrier and then contact L’Atelier des Capes & Épées as soon as possible, in accordance with the Shipping Policy.


6. RIGHT OF WITHDRAWAL AND RETURNS

In accordance with consumer law, the Customer has a period of 14 days from receipt of the products to exercise their right of withdrawal, without having to give any reason, subject to legal exceptions (in particular customised or made-to-measure products, etc.).

The conditions, procedures and exceptions to the right of withdrawal, as well as the allocation of return costs, are detailed in our Return Policy, available on the Site.
The Customer is invited to refer to it before making any return request.

If the right of withdrawal is exercised within the time limits and under the conditions provided for, L’Atelier des Capes & Épées will refund the sums paid, in accordance with the procedures set out in the Return Policy.


7. CONFORMITY AND STATUTORY WARRANTIES

Products benefit from:

  • the statutory warranty of conformity (Articles L.217-3 et seq. of the French Consumer Code),

  • the warranty against hidden defects (Articles 1641 et seq. of the French Civil Code).

In the event of a non-conforming or defective product, the Customer must contact L’Atelier des Capes & Épées as soon as possible after discovering the defect, providing photos and a precise description of the issue.

Where the conditions are met, the Customer may obtain repair, replacement or refund of the product, in accordance with the applicable legal rules.

The warranties do not cover normal wear and tear, defects or damage resulting from use not in accordance with recommendations, negligence, impact, modification or improper maintenance.


8. RETENTION OF TITLE

Products remain the property of L’Atelier des Capes & Épées until full payment of the price, including fees and taxes.


9. PERSONAL DATA

Personal information collected when ordering is necessary for the processing and follow-up of purchases, management of the customer relationship and, where applicable, for sending commercial offers.

The processing of this data is described in detail in the Site’s Privacy Policy, which the Customer is invited to consult.
The Customer has the rights provided for by the applicable regulations (access, rectification, deletion, objection, etc.), which they may exercise under the conditions indicated in said policy.


10. INTELLECTUAL PROPERTY

The texts, images, photographs, logos, product names, trademarks and all elements appearing on the Site are protected by intellectual property rights and remain the exclusive property of L’Atelier des Capes & Épées or its partners.

Any reproduction, representation, adaptation or exploitation, in whole or in part, in any manner and on any medium whatsoever, is prohibited without the prior written authorisation of L’Atelier des Capes & Épées.


11. LIABILITY

L’Atelier des Capes & Épées cannot be held liable for indirect or non-material damage that may result from the use of the products or the impossibility to use them (loss of opportunity, loss of profit, etc.).

In any event, the liability of L’Atelier des Capes & Épées for any proven direct damage shall not exceed the VAT-inclusive amount of the order in question.

No clause herein shall have the effect of excluding or limiting the seller’s liability in the event of bodily injury, death, gross negligence, fraud or in any other case where such limitation would be prohibited by law.


12. DISPUTE RESOLUTION

In the event of difficulty or complaint relating to an order, the Customer is invited to contact L’Atelier des Capes & Épées as a priority in order to seek an amicable solution:

The Customer is also informed of the possibility of using any alternative dispute resolution method (consumer mediation, conciliation, etc.), in accordance with applicable regulations.


13. APPLICABLE LAW

These Terms and Conditions are governed by French law.
In the event of a dispute and failing amicable agreement, the matter shall be brought before the competent French courts, in accordance with the ordinary rules of law. The consumer Customer benefits from the mandatory provisions of their country of residence where these are more favourable.


14. CHANGES TO THE TERMS AND CONDITIONS

L’Atelier des Capes & Épées reserves the right to amend these Terms and Conditions at any time.
The applicable version is the one in force on the day of the order, as displayed on the Site.
